If it is decided that Bankruptcy is your best option you can then choose the level of service that you require. Living overseas with assets left in the UK?

In many cases that we deal with, people still have assets in the UK such as property. It may be a case that the property has been on the market for some time and not sold, or maybe tenants have vacated leaving the property empty and mortgage arrears increasing in the background.

In these types of cases we can help to hand the property back to the mortgage company and we recommend our full bankruptcy and support service. Handing the property back is a better course of action to take then to allow the mortgage company to take the route of repossession, thus incurring more costs. Once the property is back in the possession of the mortgage company it will be disposed of and any shortfall can be incorporated into the bankruptcy. This leaves you with a "clean slate" with regard to your affairs in the UK.

 Raising the Bankruptcy Petition

Whichever service you take from our company, we will complete the Bankruptcy Petition on your behalf. This is a complex document of around 30 pages that must be completed perfectly for the High Court to accept it. If there are any gaps in the information or missing sections within the paperwork, the petition will be rejected by the High Court. The whole bankruptcy then has to be started again including re-issuing and re-signing paperwork. For this reason we do not deal with paperwork that has not been raised by our company.

Power of Attorney in Overseas Bankruptcy

Once the paperwork has been completed we then raise the Power of Attorney forms that are required to represent you in your Bankruptcy. By granting our company Power of Attorney we can act on your behalf and present the Bankruptcy Petition to the High Court. The petition and also the Power of Attorney forms have to be sent to you in your new Country of residence. You will then need to sign and have your paperwork witnessed, and once this has been completed you are then in a position to return the documents to our office.

 Once the petition is received from you we can represent you in the Royal Courts of Justice, also referred to as the High Court of London. Our professional representation will ensure that the bankruptcy is accepted, and at this stage you will be free of your UK debts. The Bankruptcy will also provide total protection for you; ands stops any harassment from your creditors and debt collection companies.

 Overseas Bankruptcy and the Insolvency Service

The next stage of the Bankruptcy process is dealing with the Official Receiver and the Insolvency Service. The Official Receiver is appointed by the High Court to deal with your bankruptcy. Depending on the level of service you have selected we will provide support to you for the next twelve months which is the standard duration of a bankruptcy in the UK. 

We will help you deal with all aspects of the Bankruptcy including the standard forms and questions that most people have to deal with.

Once the Bankruptcy is over

Once you are discharged from Bankruptcy, our sister company The Credit Hospital (www.thecredithospital.co.uk ) will, if required; assist in rebuilding your credit history in the UK. Once six years has passed from the start of your bankruptcy the bankruptcy can be removed from your credit report in the UK.
